Registering a private yacht under the Maltese flag, can be an attractive option for yacht owners due to the country’s reputable maritime flag and the various benefits it offers. Here is an overview of the process to register a private yacht in Malta:

1. Eligibility and Ownership Structure:
  • Yachts may be registered in the name of legally constituted corporate bodies or by a European Union citizen, citizens of the EEA, Switzerland or UK.
2. Appoint a Local Representative:
  • Yachts registered in the name of foreign ownership (both corporate bodies or individuals) would require the appointment of a Resident Agent in Malta to handle the registration process on their behalf and to act as a channel of communication between the Authority and the Owner.
3. Title of Ownership:
  • Evidence of ownership needs to be presented.  This may include a Bill of Sale or any other relevant documentation proving ownership of the yacht.
4. Application Submission:
  • One would need to submit a registration application through the local representative who shall assist in its completion and submission to the Maltese authorities.
  • Vessels built from 2004 would need to present a  CE certificate.
5. Survey:
  • During the first six months of provisional registration, the yacht will need to undergo a  survey conducted by a recognized surveyor approved by the Maltese authorities. This survey ensures the yacht meets safety and technical requirements.
6. Name and Marking:
  • The yacht will need to be marked with its registration name, official number and home port in accordance with Maltese regulations.
7. Payment of Fees:
  • The applicable registration fees, which can vary based on the yacht’s size, tonnage, and other factors would need to be settled upon registration.
8. Issuance of Certificate of Registry:
  • Upon registration, the Malta Flag State will issue a Certificate of Registry which is valid for 6 months, officially registering the yacht under the Maltese flag.  The Permanent Certificate of Registry will be issued once the Certificate of Survey is presented as well as the original Bill of Sale and a copy of the Deletion Certificate from the previous flag (if applicable) are presented.
9. Ongoing Compliance:
  • Once the yacht is registered the owner will need to maintain compliance with Maltese maritime regulations.
