  • The charter takes place in Malta for VAT purposes*;
  • There is a charter agreement in place for a specific term; and
  • The cumulative duration of the charter use does not exceed a cumulative period of five weeks (35 days) within a rolling 12-month period.

Where these conditions are satisfied, the reduced VAT rate applies to qualifying charter services commencing on or after 1 January 2024.

* From a VAT perspective, the short-term charter of a yacht—meaning its uninterrupted use or possession for a period not exceeding ninety (90) days—is treated as taking place where the vessel is actually made available to the customer. If the hiring extends beyond ninety (90) days, the place of supply is instead determined by where the customer is established, has a permanent address, or normally resides.
